1. Agreement to Terms
By accessing or using GoMenu, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.
2. Description of Service
GoMenu provides a digital menu platform that allows cafes to create, manage, and display their menus through QR codes. The service includes menu customization, analytics, and various templates for menu presentation.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account and password
- Restricting access to your computer and account
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Acceptable Use
You agree not to use GoMenu to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit any harmful or malicious code
- Attempt to gain unauthorized access to our systems
- Use the service for any fraudulent or illegal purpose
- Upload content that is offensive, defamatory, or inappropriate
5. Intellectual Property
The service and its original content, features, and functionality are owned by GoMenu and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain all rights to the content you upload to the service.
6. Subscription and Payment
Some parts of the service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. Billing cycles are set on a monthly or annual basis, depending on the type of subscription plan you select.
At the end of each billing cycle, your subscription will automatically renew unless you cancel it or we cancel it. You may cancel your subscription renewal through your account settings.
7. Refund Policy
We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied with our service within the first 14 days of your subscription, you may request a full refund. Refunds beyond this period are at our sole discretion.
8. Service Availability
We strive to maintain high availability of our service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the service at any time without notice. We will not be liable if for any reason all or any part of the service is unavailable at any time.
9. Limitation of Liability
In no event shall GoMenu, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
